Terms and Conditions

Please read these Terms and Conditions carefully. Before we confirm your booking, you must complete our Terms & Conditions Declaration Form.

Do not pay for flights or other travel arrangements until you receive a “Booking Confirmation” email from us. All bookings are provisional until confirmed.

Booking Process

Visa Requirements

You are responsible for ensuring you have the correct visas for all countries you’ll visit, including stopovers. Check with the relevant consulates for your passport type. Visit our Before You Go page for visa information.

Smart Traveller Registration

Register your trip with the Australian Government at Smart Traveller to receive updates about your destination.

Availability

Availability shown on our website is indicative only. All products must be double-checked due to time differences and overnight closures. Don’t book other arrangements until we send your “Booking Confirmation” email. For a full explanation of how the availability and booking process works, see our How Booking Works page.

Travel Insurance Requirement

Arrange travel insurance before paying your deposit. Deposits are non-refundable and non-transferable, covering our service fees and vendor costs.

Pricing and Payments

Pricing Structure

All prices are in Australian Dollars (AUD) unless noted otherwise. “From” prices are the lowest available, usually per person in twin-share accommodation during low season. Prices exclude meals unless specified and don’t include credit card processing fees.

Solo Traveller Supplements

Solo supplements range from 50% to 100% depending on the product and accommodation category. Contact us to discuss budget-friendly options for solo travellers.

Dynamic Pricing

For products priced in foreign currency (EUR/USD), we use dynamic pricing based on current exchange rates. AUD prices can change anytime before final payment. Contact us for current amounts before making final payment.

Payment Options

  • Pay deposit now, with the final balance calculated at the current exchange rate on payment date
  • Pay in full now to lock in the current price
  • Pay in the supplier’s currency via bank transfer (wise.com recommended)

Accepted Payment Methods

  • Bank deposit to a St George branch
  • Electronic Funds Transfer (EFT)
  • Credit cards online (most Australian cards have no surcharge, but fees may apply for certain cards)

Deposits and Cancellation

Deposits must be received within specified timeframes (usually 5 days) to secure bookings. Deposits are fully non-refundable for client cancellation for any reason. The only time a deposit might be refundable is if the vendor cancelled the departure. In that case the vendor liability is limited to the amount of the deposit.

Non-Refundable Deposits

Required deposits vary by product type:

  • Multi-day cruises and tours: 20–40% minimum, per person
  • Private charters and bespoke tours: 50–100%
  • Bookings under $1,800: Often 100% non-refundable

Client Cancellation Charges

Standard products (regularly scheduled cruises, escorted tours):

  • Up to 70 days before departure: Forfeit full deposit + service fees ($250–$5,000 per person)
  • Within 70 days of departure: 100% non-refundable for cruises and tours

Private charters, certain standard cruises and custom tours:

  • 50–100% cancellation fees apply from booking confirmation

Non-Transferable Policy

Bookings cannot be transferred to the following calendar year except in cases of legal travel impediments due to border closures. Some vendors allow name changes, but these are not guaranteed and require admin fees to be paid.

Final Payment Requirements

Balance payments are due minimum 75 days before departure, and some products require 120+ days. In the case of private arrangements, deposits will be specified within the booking. All bookings are automatically cancelled if not fully paid at least 75 days prior to departure.

Pricing Changes

Price Guarantees

Once full payment is received, prices are guaranteed against currency fluctuations and cost increases. However, this doesn’t cover government taxes, charges, or errors and omissions.

Pricing Errors

If pricing errors occur, we reserve the right to:

  • Cancel orders and provide full refunds
  • Contact customers about correct pricing
  • Decline to supply at incorrect prices

Amendments and Changes

Amendment Fees

  • Name spelling fixes: No fee (before Vouchers issued)
  • Date changes: $75–$100 per person minimum (75+ days before departure)
  • Adding people or products: $100+ per person or product
  • Post-voucher changes: $100+ per change

Accommodation and Transport Changes

If nominated ships, hotels, or cabins become unavailable, alternatives will be offered by suppliers. Claims regarding alternatives are between you and the end supplier. Specific cabin numbers, bed types, and room configurations cannot be guaranteed.

Travel Insurance

Travel insurance is strongly recommended. It should cover deposit and final payments, medical expenses, baggage loss, force majeure events, and supplier defaults. We are not liable for expenses if you choose not to purchase insurance.

  • Airline and tour operator defaults
  • Medical coverage and emergency evacuation
  • Car hire excess and baggage loss
  • Transport delays and cancellations
  • Force majeure events

Responsibilities and Liability

Our Role as Intermediary

OTSW Pty Ltd trading as Discover Croatia Holidays (ABN 16 126 189 375) acts as an intermediary, re-selling holidays and services. We don’t provide transport, accommodation, or other facilities directly — these are provided by end suppliers (principals).

Liability Limitations

We are responsible only for our agency services and accept no responsibility for:

  • Acts or omissions by end suppliers
  • Loss, injury, or property damage during travel
  • Force majeure events beyond our control
  • Supplier marketing material inaccuracies

Consumer Claims Process

If problems arise during travel:

  1. Contact the service provider immediately (phone numbers on vouchers)
  2. Take photos and videos as evidence
  3. Submit written claims within 5 days of the event
  4. We’ll act as intermediary with end suppliers where possible

Consumer Protection and Legal

Accreditation

We hold IATA TIDS Code: 96-8 4638 5. We previously held ATAS Accreditation No: A15818. We voluntarily withdrew from AFTA/ATAS in 2021. Our Travel Agent Licence was 2TA6097 until it was disbanded by the Australian government in 2015.

Governing Law

This agreement is governed by the law of New South Wales, Australia.
